We are pleased to provide this privacy policy (this "Policy") to inform you of our practices with respect to how we collect and use personally identifiable information about persons who correspond with us through this Site. MDC will post further updates on this Site.

By using this Site or otherwise providing personally identifiable information to MDC, you consent to the following terms. If you do not agree with any of these terms, do not access or otherwise use the Site or any information or materials contained on the Site. Your use of the Site shall be deemed to be your agreement to abide by each of the terms set forth below.

What we collect. You may anonymously visit this Site to learn about MDC and its products and services. The data that we regularly collect about visitors to this Site (e.g., number of visitors, browser type, pages accessed, duration of visit, etc.) does not enable us to identify you. We may collect the name or Internet protocol address of your Internet server, but this information generally does not reveal your identity.

The only personally identifiable information that we collect about you, such as your name, address, phone number, e-mail address or other information, is what you voluntarily submit to us by creating an account, by placing an order, or by otherwise sending us correspondence through this Site. If you do not choose to communicate with us, your visit to this Site will not provide us with information by which we could personally identify you. If you have communicated with us and no longer wish to receive our communications, you may contact webmaster@mdcwall.com to delete your personally identifiable information from MDC’s system.

How we collect it. MDC collects your personally identifiable information when you correspond with us or complete a form on this Site, such as by creating an account or placing an order.

Use of Cookies. To facilitate your use of this Site, we use "cookies." A cookie is a small amount of data that our servers transfer to your browser and that only our servers can read. When you log onto this Site, the cookie file captures your username, unique session identifier number and other session data to enable you to traverse through this Site's various screens without having to authenticate yourself at each new screen. If you do not wish to utilize cookies, you may disable or delete them from within your Internet browser application by accessing the security or privacy settings. You may be required to have cookies enabled to access certain portions of this Site.

Use of Information. MDC uses your personally identifiable information to fulfill your order, respond to your correspondence, to provide you with any materials or information that you have requested, to send information to you, as requested, to contact you when reasonably necessary, to perform statistical analyses measuring relative interest in the various products and services offered by MDC and to administer this Site.

A Special Note about Children. MDC does not knowingly gather any personally identifiable information from children under the age of 13. You must be 13 years of age or older to access the Site. MDC has no interest in collecting information from children under the age of 13.

In addition, MDC may also disclose such information to business partners or third party service providers who MDC employs to provide services on its behalf (such as marketing and information gathering services). MDC may transfer to, or share your personally identifiable information with, such business partners or service providers only to the extent the disclosure of such information is reasonably necessary to enable such business partners or service providers to fulfill their obligations to MDC or otherwise improve the services offered by the Site. Lastly, MDC may disclose your personally identifiable information upon a transfer or sale to another entity of all or substantially all of MDC's assets or stock in MDC's line of business to which this Policy relates or upon any other corporate reorganization.

Links. For your convenience, we may provide links to certain third party websites or references to certain third parties' products or services. If you choose to visit a third party's website or use its products or services, please be aware that the third party’s privacy policy, and not MDC’s, will govern your activities and any information you disclose while interacting with the third party.

Do Not Track Requests. Currently, certain browsers, including Firefox, Google Chrome, Safari and Internet Explorer, offer a "do not track" (or, "DNT") option. This option, using a technology known as a DNT header, sends a signal to websites visited by the user about the user ’s DNT preference, if any, set on the browser. MDC does not currently commit to responding to browsers’ DNT signals. We cannot make this commitment because no common industry standard for DNT has been adopted by industry groups, technology companies, or regulators.

Third Party Services. Some Site features may be served by third parties, including advertisers, ad networks and servers, content providers and application providers. These third parties may use cookies, alone or with web beacons or other tracking technology, to collect information about you when you use the Site. They may be able to associate the information they collect with your personally identifiable information, or they may collect information, including personally identifiable information, about your online activities over time and across other website and online services. They may use this information to provide you with behavioral advertising or other targeted content. We cannot control any third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

Security. MDC employs procedural and technological measures reasonably designed to protect your personally identifiable information from loss or unauthorized access, disclosure, alteration or destruction. These methods may include use of encryption and firewall technology.

Policy Changes. MDC reserves the right to change this Policy and will post any revisions on this Site. We encourage you to review this Policy regularly for any changes. Your continued use of this web site will be subject to the then-current privacy policy. If deemed appropriate by MDC, MDC will send changes to this Policy to you via e-mail.

Miscellaneous. This Policy shall be governed by the laws of the State of Illinois, U.S.A. without regard to conflict of laws principles. The parties agree that any claim shall be brought in the federal and state courts located in Dupage County, Illinois, U.S.A., and both parties hereby submit to the jurisdiction of such courts. If any provision hereof shall be held illegal, invalid or unenforceable, in whole or in part, such provision shall be modified to the minimum extent necessary to make it legal, valid and enforceable, and the remaining provisions of this Policy shall not be affected thereby. The failure of MDC to enforce any right or provision of this Policy shall not constitute a waiver of such right or provision. This Policy constitutes the parties' entire understanding regarding the use of the Site and personally identifiable information collected from persons who correspond with MDC, and supersedes any and all other prior or contemporaneous agreements, whether written or oral.
